South state motorcycle dealers pay $180,000 in penalties

Illegal sales put public health and safety at risk

SACRAMENTO -- The California Air Resources Board last month fined two San Diego-area motorcycle dealers $180,000 for illegal sales.

In 2006, ARB enforcement officers got an anonymous tip that San Diego-based GP Motorcycles and Moto Forza of Escondido, Calif., were illegally selling Husqvarna off-road motorcycles as on-road models. ARB investigators confirmed the allegations and took action.

"Companies that deliberately flout the law are often assessed higher penalties," said ARB Chairman Mary D. Nichols. "Playing by the rules from the start is the most cost-effective, smart business plan any company can follow."

GP Motorcycles and Moto Forza sold several dozen off-road motorcycles to customers who thought they were purchasing on-road models. Many of the bikes were outfitted with so-called "street-legal" kits and licensed for on-road use, both illegal in California.

ARB revoked all the on-road licenses and registrations for the illegal bikes sold by GP Motorcycles and Moto Forza. The motorcycle owners were permitted to return their license plates to the Dept. of Motor Vehicles for the appropriate off-road riding stickers and plates.

Off-highway vehicles do not meet federal motor vehicle safety standards -- or ARB's emission standards -- required of on-road motorcycles. There are no street-legal kits or conversions that make an off-road motorcycle legal for on-road use or registration. A motorcycle is either certified by ARB for on-road use or off-road use.

California's air pollution control efforts include regulating emissions from cars, trucks, buses and motorcycles. Smog can damage lungs, cause coughing and chest tightness, and worsen asthma symptoms while also affecting crop yields.

The Air Resources Board is a department of the California Environmental Protection Agency. ARB's mission is to promote and protect public health, welfare, and ecological resources through effective reduction of air pollutants while recognizing and considering effects on the economy. The ARB oversees all air pollution control efforts in California to attain and maintain health based air quality standards.

BAKERSFIELD, CA (August 21, 2006.) The California Air Resources Board (ARB) recently became aware of the fact that some off-highway motorcycles may have

been inappropriately converted to street legal registration by the Department of Motor Vehicles since new policies banning that practice were adopted in 2004.

In mid 2003, new policies were issued by the Department of Motor Vehicles that blocked owner or dealer conversions of

off-highway motorcycles. This was in response to ARB requirements that all street legal motorcycles must be certified by ARB that they meet street legal motorcycle emission standards.

DMV policies had historically allowed conversions after appropriate lighting and safety equipment was installed, but those policies had not been updated to reflect newer

ARB regulations adopted subsequent to the DMV policy development. After

discussions among ORBA, the American Motorcyclist Association (AMA), DMV and ARB, a delayed implementation of the new policy until

1-31-04 was adopted, allowing owners who had already purchased or ordered

motorcycles in good faith with the intent to utilize the existing DMV policy to complete the conversion to street legal status.

After 1-31-04, no off-highway motorcycles were supposed to be converted and registered by DMV.
 
Currently, DMV and ARB are auditing DMV records to determine if off-highway motorcycles have been converted to street legal status inappropriately since the 1-31-04 cut-off date.

Preliminary indications are that some motorcycles may have been inappropriately converted, and a more detailed audit is underway to determine if that is the case and if so,

how many of them were done, and to whom they belong. Owners of any off-highway motorcycles that are determined to be inappropriately converted will be contacted by DMV by mail,

informed their street legal license plates are no longer valid, and offered the opportunity to register the bikes as off-highway motorcycles.


The only motorcycles that are allowed to be street registered are models that are certified by ARB as meeting highway emission standards,

those converted previous to the 1-31-04 deadline and motorcycles of model year 1977 and older. Anyone who converted their off-highway motorcycles to street legal

status prior to the 1-31-04 date will not be affected, and their current status will not change.

 

For those California residents interested in owning a street legal motorcycle that performs well off-road, there are several good options. Until now, there have been  few options for those buyers,

and even those were not as desirable to some buyers as converting a lighter, higher performance off-highway motorcycle. Fortunately, a few manufacturers have responded by producing

dual sport bikes that perform well off-highway and are lighter than traditional dual sport models. It is expected that other companies may follow this trend.

A Reprieve is here for california and dual sport conversions.

A bulletin is stating the following: Any and all green sticker off road

motorcycles which show a purchase date of January 1, 2004

or earlier can register their off road motorcycles for dual sport use. Paperwork to start the

DS registration process must be started by February 1, 2004.

Detailed information regarding this statement will be available as soon as we know more.

Remember that most green sticker (cali bikes) bikes can become

DS legal for under $200 + registeration fees etc etc

Buy a bike or register your current bike in the next closet state that allows DS conversions.

Most neighboring states allow the DS conversion of dirt bikes. (yea)

You are required by California state law to register your bike in California when the vehicle has been in the state for over 20 days.

Here is the trick or alternative
Add a 2nd name (or use your middle name or the initial IE: Elvis Aaron Presley or A. Presley get it )

to the title when you title the vehicle. And then use that person as the lien holder or owner and you are the add on like a kid when they turn 16! hint hint.

Additional reason for having your name on the reg.

The bike could be stolen and you could just be saying that the bike is yours.!

Then you are unlikely to get the over 20 days in California get it registered ticket and hassle by the bronze.

V.C. 4152.5 Out of state vehicle in CA within 20 days

If you do get pulled over just tell the officer real nice that theWR 450F-E that your riding is your granny's and that she rides it most of the time or is the

lien holder on the bike and that she owns it for 50 more payments and visits you often and is letting you ride it this weekend!!!

That is your 2nd name on the title.

Of course your wife, sister, brother etc can help you with the same thing Get It!!

When you have the additional name on the title then you are not obligated to have it registered in that state until its paid off or

if its really your brothers bike then he is coming to get it soon from you. He was just nice and put you on the reg so you could borrow very often!!

All the information below is null and void till something changes.
Big news for owners or buyers of bikes and atvs and the red sticker in California.

The Ban on 3 or C vin number, 8th digit of the vin and the red sticker bikes is over
for all vehicles pre 2003 models should get green stickers when you renew your sticker.

If you want your new green sticker before the renewal date you could go to DMV and ask for a new sticker because the old one was damaged.
Just ask nicely for your replacement OHRV sticker.

will get a green sticker if the vehicle is pre 2003

or

2002 and 1998 machines

Green Stickers are issued to OHRVs certified by their manufacturer to meet the California OHRV emission standards (anti-pollution) and ALL 2002 model year and older OHRVs.

Red Sticker


At California OHRV riding areas, seasonal use only.


A list of the seasonal riding periods is available by calling the Air Resources Board at 800-242-4450 or on the web at

Red stickers are issued to 2003 model year and newer OHRVs that are not certified to California OHRV emissions standards.

The State of California requires the following equipment for a dual registration:

Headlight with a high/low beam, High beam indicator light visible to the operator to show when high beam is on, 4 turn signals front & rear at minimum distance,

Turn Signal Switch left, right on/off switch, hi-lo beam switch & horn, a battery powered taillight and brake light taillight should operate for

20 minutes on battery power alone, brake switch front or rear and a rear view mirror.

(California requires only a left side mirror)

(Some states require left & right side mirrors)
Most standard dirt bikes meet the varying state requirements for brakes, handlebar height, and other features.

Check the vehicle code for your state regarding individual peculiarities.

Tires and lights should have some indication that they are DOT approved.
You can visit the local CHP Office for a copy of CHP Form 888.

You will need to get a DMV registered motorcycle shop to stamp this form
and put the stamp and dealer # if applicable on it.

They will fill out the VIN #, sign it and date it.
You will need to have the dealer that you buy the new bike from fill out the registration a special way to get the plate,

You MUST Have the section on the registration that says Body Type filled out perfect.

Did I Say that it must be filled Perfect!!

Very Important if you want a plate and a green sticker.

Example Body Type = MC

Body Type = MX = NO GOOD
Then this will alert the DMV that you have a Red Sticker dirt bike and or no chance of getting a green sticker and a plate.

If you have a bike that has a 3 or a C in the 8th digit of the VIN then you are in trouble.

Even if you register your bike in Vermont or another state,
there is VERY GOOD chance that when you bring the bike back into California (if you try this) that you will not be able to get a plate and or a green sticker.

As of 1-1-00 The red off road sticker program has finally started to hit the Dual Sport rider.

It looks like you may not be able to dual register your bike if it is not a Cali EPA model.

What this means is if your bike gets a red sticker or has a 3 or a C in the 8th digit of the

VIN number you may be out of luck to get the old plate for your bike.

Some dealers in the US have these bikes for sale.
Check the VIN number very carefully before buying!!

Alternative/Helpful Hint #3
When you register your bike in Vermont or another state other than California (IE: 3 or C in the 8th digit of the vin machine)

and ride the bike most of the time in California then you could be ticketed by police.

You are required by California state law to register the bike in California when the vehicle has been in the state for over 20 days.

Here is the alternative

MAKING A MOTORCYCLE STREET - ENDURO LEGAL OR MORE

If all else fails
Try the state nearest to you that allows conversions. You might want to register the machine in your relatives name IE:
brother, sister, mother, father, uncle, aunt or better your middle name. If you use your first name (John Smith) aka
( John Anthony Smith) vs (Tony Smith)

If you get pulled over by the bronze* in your home state and your are carrying a dl* from the same state. And the machine you are riding is
registered in a different state and your full name is on the reg* and you own it, then it could get ugly. IE: California requires that after you and or the vehicle has been in the state for 20 days it is required that you register hte vehicle and or get adrivers license in that state asap.
IE:-Example: You do not want to register the machine in your full name if you are living in california and have the bike registered in arizona.

The
VERMONT State route for regestering your machine is not the super easy way that it was at one time ( easy vermont regestration time was 2004 thru 2007 appx).
You still might be able to use the vermont route but there are restrictions that you will need to be aware of.
If your machine does not say for off road use only on it you might still be able to go the vermont route, might be able to is the key word.
